Description:

We are seeking a highly skilled Legal Counsel to assume a pivotal role in fostering a risk-aware culture and ensuring effective risk management practices in accordance with pertinent lien laws and trust statutes within the construction industry. The successful candidate will play a key role in understanding our existing construction factoring product and navigating the intricacies associated within the receivables financing space. Collaborating closely with the credit team, you will be responsible for financial product underwriting and legal recourse on non-performing assets. As our first in-house counsel, you will assess, and communicate relevant legal requirements pertaining to financial risk within construction factoring. This position will report directly to the CEO.

Key Responsibilities:
  • Collaborate with the leadership team to achieve key business objectives and ensure compliance with all pertinent legal requirements.
  • Provide comprehensive legal support and advice applicable to lien laws and trust statutes.
  • Assist in collection and recovery efforts related to non-performing assets.
  • Familiarize yourself with key compliance frameworks and contribute to proactive monitoring, risk identification, and escalation.
  • Think through and provide guidance with complex concepts and tackle them in an organized and efficient manner.
  • Participate in product and cross-functional initiative developments throughout Constrafor.
  • Liaise with outside counsel to streamline all legal processes and maximize value on litigation and collection efforts.
  • Draft, negotiate, and examine client and vendor agreements.

Qualifications:
  • Juris Doctor (JD) from an accredited law school with the ability to practice law in New York.
  • 5-8 years of legal experience in construction litigation or transactional work.
  • Experience representing general contractors, subcontractors or owner representatives.
  • Proficiency in factoring, structured credit, or asset-backed financing.
  • Exceptional judgment and ability to act decisively in situations requiring quick but thorough analysis, particularly in financing and counter-party risk mitigation.
  • Previous knowledge of filing mechanic liens and surety bond claims.
  • Thrive in a dynamic, fast-paced environment and able to turn work around quickly, as needed.
  • Strong communication skills and the ability to work across functions.
