Position Information:
Texas is embarking on a record-setting $100 billion 10-year statewide roadway construction plan to help grow transportation and the economy in Texas.

The legal team in A Government Entity's ROW Division plays a crucial role in assisting with the purchase and or condemnation of property needed for the projects in this plan. The ROW Division and its legal team are centered in Austin, but also have staff and offices distributed around the state to better serve each local A Government Entity district.

A ROW Division attorney works closely with project staff and consultants to assist with real property conveyances, title curative matters, service of process questions, and regulatory and statutory compliance relating to eminent domain process. Key goals of the position are to serve the fast-paced needs of A Government Entity's projects, to provide quality and compliance control for cases proceeding to litigation counsel, and to provide analysis of complex and varied issues relating to ROW Division's areas of responsibility, including contracts, utility issues, commercial sign regulation, and real property disposition.

The ideal candidate will have a background in real property law, particularly as it relates to property acquisitions on behalf of a condemning entity and will be an experienced team-player.

Minimum Salary: 83,104.00 Maximum Salary: 120,000.00

Position Description:
Attorney III
Performs highly complex professional legal work concerning the compliance and interpretation of federal and state laws, rules and regulations for the Department. Work requires contact with governmental agencies and private entities. Employees at this level establish their own work plan and priorities to meet set objectives. Issues are rarely referred to the supervisor but are handled at the occurrence.

Attorney IV
Performs advanced professional legal work concerning the compliance and interpretation of federal and state laws, rules and regulations for the Department. Work requires contact with governmental agencies and private entities. Employees at this level are virtually self-supervising and assume direct accountability for the work product.

Essential Duties:
  • Drafting, reviewing, and approving conveyances and other agreements related to right of way acquisition.
  • Detailed review of eminent domain case files for sufficiency and compliance.
  • Reviewing and commenting on bills filed by the Texas Legislature which impact A Government Entity.
  • Providing prompt and courteous service to ROW Division and its customers.
  • Performs other duties as assigned.

Minimum Qualifications:
Attorney III

Education: Juris Doctor (JD) in /from an accredited law school.

Experience: 3 years experience in governmental and administrative law, civil procedure, real estate law, or related. (Experience can be satisfied by fulltime or prorated part-time equivalent).

Licenses and Certifications:
  • Valid driver's license. This position requires driving a state vehicle.
  • Must be licensed to practice law in the State of Texas.

Attorney IV

Preferred Qualifications:
Attorney III
3 years in Governmental and/or real estate law, or related. Experience can be satisfied by full-time or prorated part-time equivalent.

Attorney IV
  • 5 years in Governmental and/or real estate law, or related. Experience can be satisfied by full-time or prorated part-time equivalent.
  • No Substitution
