General Description:
Under the supervision of the Deputy Division Chief - Field Legal Practice performs all necessary legal work for the Office of Attorney General (OAG), Child Support Division (CSD), and Legal Services Division. Work involves research, trial litigation and consultation, subpoena review and response, motion drafting, and oral argument before state and federal courts; drafts memorandum for division leadership, performs complex legal research, and provides legal advice and counsel on pending legal issues.

Essential Position Functions
  • Represents the State of Texas in Litigation for The Child Support Division (csd)
  • Provides legal advice, counsel, and assistance to CSD management and legal teams on family law matters and issues related to child support litigation
  • Prepares and responds to discovery requests and pleadings
  • Serves as CSD, Legal Services liaison for litigation involving CSD referred and assigned to A&L divisions and AAGs
  • Provides oversight and resolution of all subpoenas issued to CSD and responds to law enforcement investigation or attorney requests involving CSD case file information
  • Researches and analyzes routine to highly complex factual and legal issues and prepares trial briefs and memoranda on routine to complex cases and issues; and assists field office staff in litigating complex cases in court
  • Maintains tracking and provides routine updates on all assigned cases and legal issues assigned to the division
  • Works on special projects and participates in various workgroups / conference / meetings as assigned by the Deputy
  • Division Chief - Field Legal Practice, including developing and delivering presentations on IV-D legal or practice issues
  • Develops and delivers continuing legal education for CSD legal teams as needed
  • Assists the Deputy Division Chief – Field Legal Practice with monitoring of statewide administrative license suspension cases and represents CSD in administrative hearings as needed
  • Provides other assistance to statewide field legal teams as needed
  • Develops and delivers legal training and presentations to CSD staff on assigned legal topics
  • Reviews legislation and provides analysis to CSD management
  • Performs related work as assigned
  • Maintains relevant knowledge necessary to perform essential job functions

  • Ensures security and confidentiality of sensitive and/or protected information
  • Complies with all agency policies and procedures, including those pertaining to ethics and integrity

Qualifications:
Minimum Qualifications:
  • Education: Graduation from high school or equivalent
  • Education: Bachelor's degree from an accredited college or university
  • Education: Graduation from an accredited law school with a Juris Doctor (J.D.) degree
  • Licensed as an attorney in the State of Texas
  • Member in good standing with the State Bar of Texas
  • Experience: Four years of full-time experience as a licensed attorney
  • Knowledge of family law, the Texas Family Code, and the Texas Rules of Civil Procedure
  • Knowledge of state and federal laws and regulations governing confidentiality of Title IV-D records
  • Skill in legal research, drafting legal documents, crafting sound, persuasive legal arguments, and preparing legal memoranda and briefs
  • Skill in legal advocacy, legal writing, and negotiation
  • Skill in serving as a trial lawyer, preparing sound opinions, conducting investigations, and performing legal research
  • Skill in using a personal computer for word processing and data entry/retrieval
  • Skill in handling multiple tasks, prioritizing, and meeting deadlines
  • Skill in effective oral and written communication
  • Skill in exercising sound judgment and effective decision making
  • Ability to receive and respond positively to constructive feedback
  • Ability to work cooperatively with others in a professional office environment
  • Ability to provide excellent customer service
  • Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG work space within OAG work location, and perform in-person work with coworkers (e.g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave)
  • Ability to arrange for personal transportation for business-related travel
  • Ability to work more than 40 hours as needed and in compliance with the FLSA
  • Ability to lift and relocate 30 lbs.
  • Ability to travel (including overnight travel) up to 15%

Preferred Qualifications:
  • Experience: Family law litigation experience
  • Experience: Criminal procedure and negotiation with state and federal law enforcement agencies
  • Experience: Lead counsel, assistant counsel, or staff attorney in criminal or civil litigation
  • Experience: Responding to discovery
  • Experience: Defending state agencies in civil litigation
  • Experience: Responding to and resolving atypical litigation
  • Experience: Texas Child Support Program or other Title IV-D program experience
  • Experience: Law Review and/or judicial clerkship
  • Experience: Independent case management and high-volume legal practice
