Current Need:
A Medical Supplies, Pharmaceuticals & Healthcare Solutions Company's well-regarded Law Department is seeking an experienced Sr. Counsel to support A Medical Supplies, Pharmaceuticals & Healthcare Solutions Company's PSaS Commercial Strategy and Innovation segment, which includes the licensing of SaaS services to pharmacies, health systems and hospitals.

PSaS Commercial Strategy and Innovation is a business unit of A Medical Supplies, Pharmaceuticals & Healthcare Solutions Company that provides innovative technologies that support retail pharmacies, health care systems, manufacturers, and hospitals. This business supports our customers with a comprehensive, expanded portfolio of solutions designed to help them drive business growth, realize greater business efficiencies, deliver high-quality care, and better manage inventory and their 340B Program.

The Sr. Counsel is an independent, business-minded, agile, healthcare-focused, technology, transactional and regulatory attorney who serves as a highly visible point of contact for a wide array of legal and business matters. Reporting to Managing Lead Counsel and working directly with several A Medical Supplies, Pharmaceuticals & Healthcare Solutions Company business teams, the Counsel possesses exceptional professional judgment and provides decisive day-to-day legal counseling and advice to all levels of the organization, including all of the following: Issue identification and escalation to business stakeholders and supervising attorneys, as appropriate; Drafting, reviewing, and negotiating contracts, from scratch or template, as appropriate; Providing guidance to business stakeholders on contract and regulatory risks and benefits to ensure successful completion or resolution, with escalation to supervising attorney, business teams, business owner, and executive management, as necessary; Serving as responsive point of contact with attorneys representing customers, vendors, service providers and other A Medical Supplies, Pharmaceuticals & Healthcare Solutions Company affiliates.

This position requires a keen understanding of the ever-changing business, legal, and healthcare regulatory environment relevant to A Medical Supplies, Pharmaceuticals & Healthcare Solutions Company's contracts with its customers and vendors. The successful candidate will be expected to serve as a role model of professionalism and demonstrate strong leadership traits as part of a mutually supportive, highly engaged team with an exceptional reputation for performance and positive culture.

Key Responsibilities include:
  • Identifying, analyzing, researching, and resolving legal and business issues and making appropriate recommendations to business and keeping supervising attorney informed;
  • Identifying and analyzing risks in business strategies or proposed legal agreements and escalating appropriately to business and legal leaders;
  • Drafting and negotiating contracts directly with counsel for contract counterparty;
  • Interacting directly with outside counsel or internal McKesson counsel to coordinate, scope, and understand legal research matters or initiatives;
  • Developing an excellent rapport with the business teams and earning the trust of senior business leaders;
  • Consulting on legal-risk, regulatory, and business provisions in contracts and strategies including for new products and new features;
  • Monitoring compliance with internal McKesson business and legal processes and policies;
  • Preparing and delivering informative and engaging legal presentations for the senior attorneys and presenting to senior business unit leaders, as applicable;
  • Providing legal guidance as an escalation point for paralegal staff managing their assignments;
  • Assessing transactions and issues and exercising appropriate judgment as to when to seek input from additional subject-matter experts;
  • Independently drafting, prioritizing, and managing a robust portfolio of transactional work;
  • Working with minimal supervision, a high degree of initiative and excellent independent judgment in escalating issues within broadly defined practices and policies.

Education:
J.D. from ABA accredited law school required

Minimum Requirements:
  • 7+ years of legal-practice experience with a substantial portion of that time spent practicing some aspect of healthcare law in a corporate legal department or law firm. Prior in-house counsel experience preferred but not required.
  • Admission to applicable state bar, registration as in-house counsel, or ability to gain admission or registration for either in applicable state within 90 days.

Critical Skills:
  • Legal experience with high-volume, sales-driven, complex commercial contracting – helpful if in a healthcare technology context.
  • Experience providing business-focused legal counsel to a corporate client in the healthcare sector, as in-house counsel or in a healthcare-focused practice group of a law firm.
  • Highly Proficient in Microsoft Office applications (Outlook, Word, Excel, PowerPoint, OneNote) OneDrive, SharePoint and general Intranet and Internet research skills.
  • Exceptional written and oral communication skills with emphasis on knowing the audience.
  • Ability to collect and present information, clearly, concisely and logically.
  • Ability to work effectively with clients and promote the reputation and integrity of McKesson and the McKesson Law Department.
  • Experience communicating effectively with all levels of personnel, both internal and external to the organization.
  • Ability to create, tailor, and deliver impactful educational presentations to other legal professionals or non-legal business leaders on complex legal topics in an understandable, engaging way.

Additional Knowledge & Skills:
  • Prefer experience in healthcare technology or information technology business.
  • Excellent writing and verbal communication skills.
  • Ability to work effectively and efficiently with business unit leaders and promote the reputation and integrity of McKesson and the McKesson General Counsel Organization.
  • Experience working in a healthcare regulatory environment preferred, including Federal Anti-Kickback Laws.
