Job Description Summary:
The Senior Counsel, Regulatory Law, will be a member of the Regulatory Law Group and will report to the VP Compliance Officer and Chief Regulatory Counsel.

The successful candidate will be a U.S. based attorney with significant experience in global trade laws and regulations and will be responsible for providing legal advice and regulatory interpretations for the Company's operations to ensure consistency and oversight related to the legal obligations that exist under a range of international trade laws and regulations. The Senior Counsel, Regulatory Law will be the initial and primary point of contact for addressing legal and regulatory matters related to international trade and will work closely with other business functions (e.g., commercial teams, global trade compliance, finance, supply chain, procurement, contracts, etc.) to assist in the implementation of legal requirements across BD's businesses. This attorney also will be responsible for successful implementation of the company's U.S. government contracts compliance program.

The successful candidate will be a U.S. based attorney with significant experience in global trade laws and regulations and will be responsible for providing legal advice and regulatory interpretations for the Company's operations to ensure consistency and oversight related to the legal obligations that exist under a range of international trade laws and regulations. Act as the initial and primary point of contact for addressing legal and regulatory matters related to international trade and will work closely with other business functions (e.g., commercial teams, global trade compliance, finance, supply chain, procurement, contracts, etc.) to assist in the implementation of legal requirements across BD's businesses. Responsible for successful implementation of the company's U.S. government contracts compliance program.

Job Responsibilities:
  • Provide legal advice and guidance on global trade matters, including global import/export compliance, customs, FCPA, ABAC, supply chain, and global trade regulations
  • Provide assistance with the establishment of consistent and common interpretations related to global trade, import/export, FCPA, ABAC and supply chain matters across business units
  • Review and provide legal guidance on the implementation of the Company's global trade compliance programs and policies
  • Monitor and analyze legal and regulatory changes in global trade laws and regulations and advise the Company's business leadership on the legal impact of such changes. Coordinate monitoring and analysis with the Global Trade Compliance organization within the Company
  • Represent the Company in trade related matters before government entities and organizations – both in the United States and abroad
  • Coordinate, develop, prepare and work with outside counsel (when needed) to respond to and address inquiries from U.S. Government and non-U.S. Government enforcement, policy or licensing agencies
  • Demonstrate detailed knowledge of U.S. and global trade compliance requirements as well as sound judgment with respect to the interpretation of those requirements
  • Proactively identify and advise on government contract compliance risks related to business activities, develop solutions to mitigate risk and influence key business leaders
  • Provide guidance and training to business teams on U.S. Government contract compliance requirements
  • Assist in maintaining enterprise level U.S. Government contracting policies to guide U.S. Government business processes, including periodic assessment of changes or improvements needed to policies and processes
  • Review compliance with U.S. Government contract terms and conditions and proposed pricing substantiations and provide compliance opinions concerning U.S. Government pricing rationale/substantiation
  • Monitor changes in laws that could potentially impact how BD does business with the U.S. Government, make recommendations for continued compliance, and provide legal guidance related to implementation of programs to ensure continued compliance
  • Develop innovative solutions to government contract compliance issues in support of strategic business initiatives and objectives

Qualifications:
  • Juris Doctor degree from an accredited law school. Licensed to practice law in the United States
  • At least 5 years of relevant experience in global trade law and U.S. government contracting
  • Strong, in-depth knowledge of global trade laws and regulations and of the key U.S. Government agencies responsible for trade laws and regulations
  • Government contracting and pricing experience and knowledge of applicable U.S. Government statutes, regulations and contract terms and related implications and impacts strongly preferred

  • Excellent analytical, communication, and drafting skills
  • Ability to work independently and as part of a global team
  • Demonstrated ability to exercise independent judgment effectively
  • Ability to draft and implement key corporate policies and procedures to empower and enable associates to achieve business objectives in a compliant manner
  • Tech savvy with excellent presentation and people skills.
  • Ability to travel approximately 10% of the time
